Exploiting Digitalisation to Increase the Use of Framework Decision 2008/947

IPS_Innovative Prison Systems is leading a new European project that aims to enhance cross-border judicial cooperation by facilitating knowledge of EU Member States’ probation systems through an innovative digital solution.

The European Union’s commitment to fostering mutual trust and cooperation in criminal justice systems is central to its broader mission of maintaining a unified and effective judicial area. In this context, Framework Decision 2008/947/JHA (FD 947) represents a crucial legal instrument designed to facilitate the recognition and supervision of probation measures and alternative sanctions across Member States. By enabling individuals to serve non-custodial sentences in their home countries or other locations where they have substantial ties, FD 947 prioritizes rehabilitation and social reintegration, offering a humane and effective alternative to incarceration.

However, despite its transformative potential, the practical implementation of the instrument has encountered significant challenges. Variations in Member States’ legal frameworks and procedural practices, coupled with lack of awareness and knowledge of FD 947, often undermine its effective application. These discrepancies can lead to procedural delays, limited use of probation measures, and inconsistencies in how alternative sanctions are administered across borders. Such issues not only weaken the rehabilitative goals of the FD, but also risk eroding mutual trust among Member States.

J-CAP Next: Modernising probation measures with the European Probation Software

J-CAP Next is an EU co-funded initiative designed to address the challenges and gaps identified in the practical implementation of FD 947. Building on the achievements of previous projects, most notably from the European Probation and J-CAP Projects, this initiative focuses on developing an innovative solution to streamline cross-border judicial cooperation, ensuring that probation measures and alternative sanctions are not only recognised but implemented in a way that upholds fairness, efficiency, and the rights of the individuals involved.

A cornestone of the project is the development of European Probation Software (EPS), a digital tool designed to streamline the recognition and implementation of probation measures and alternative sanctions across EU Member States. The EPS will provide justice practitioners with comprehensive, up-to-date, and easily accessible data on probation systems and legal frameworks in the EU Member States. This tool will serve as a critical instrument in the promotion of smoother and more consistent handling of non-custodial sentences.

Beyond its technical advancements, J-CAP Next places significant emphasis on fostering trust and collaboration among judicial systems across Europe. Through cooperative learning and awareness-raising events, the project will help judicial practitioners understand the benefits of FD 947, share best practices and learn how to properly use the EPS. These activities aim to build mutual trust and reduce disparities in
the application of probation measures and alternative sanctions.

The project also addresses critical societal challenges by improving the rehabilitation prospects of vulnerable individuals, such as foreign probationers, within the context of alternatives to detention. By providing user-friendly, standardized, and accessible tools, J-CAP Next ensures that judicial professionals can better leverage probation measures to achieve fairer outcomes while reducing the reliance on incarceration. Ultimately, the initiative seeks to create a more unified, effective, and digitally enabled judicial system across the EU.

The J-CAP Next project officially began with a virtual meeting on 17th December 2024, bringing together consortium members to discuss and set the framework for the project’s objectives and strategies. This meeting was a critical moment to plan the next 24 months of this initiative.
